Nile Miles: Terms & Conditions

What are Nile Miles?

'Nile Miles' are the central component of our unique customer rewards program. Essentially, Nile Miles are points you earn for purchases made through TheNile.com.au which you can use to claim a variety of rewards.

You can view our current Nile Miles rewards at any time by selecting the Nile Miles tab on your account management screen.

Please note that Nile Miles will only be awarded for purchases made through an account. Creating an account is simple, easy and will speed up future purchases through our website. You can make an account today by visiting our account page.

Nile Miles are subject to terms and conditions as outlined below.

Earning Nile Miles

The number of Nile Miles you will earn for any given item is displayed on its product page, clearly denoted by our distinctive sailing boat logo ().

Making a purchase while logged in to an account will automatically award you with the appropriate amount of Nile Miles. Please note that all Nile Miles are subject to a thirty day cooling off period during which your Nile Miles cannot be used. After the cooling off period has expired, your Nile Miles will move from the pending category into the active category and you'll be free to spend them as you wish.

If, for whatever reason, your order is unable to be completed and the cost of your purchase is refunded, the Nile Miles earned from that order will be deducted from your account.

Your current tally of both pending and active Nile Miles can be viewed in the Nile Miles tab of your account management page.

Redeeming Nile Miles

Nile Miles can be redeemed for a selection of rewards as featured in our Nile Miles substore. You can view our current Nile Miles rewards at any time by selecting the Nile Miles tab on your account management screen. Currently, Nile Miles may only be redeemed for Gift Cards. Please check back regularly as rewards are subject to change in the future.

The redemption of Nile Miles for any reason will be administered by us within 3 business days and cannot be reversed.

Terms & Conditions

1. Earning Nile Miles

You are entitled to accrue Nile Miles only when you have registered for an account with TheNile.com.au.

You will accrue a designated number of Nile Miles (as notified to customers on the individual product listing) for every purchase charged and billed on your dedicated Nile Account. Subject to these terms and conditions, Nile Miles are awarded after a thirty day cooling off period provided the order has not been refunded. The Nile Miles allocated towards each purchase are based on the Australian dollar value for the retail price of each item and are subject to change at any time.

No Nile Miles will accrue in respect of:

  • Purchases of Gift Certificates
  • Orders paid for via redemption of Nile Miles
  • Instances in which the customer fails to purchase from their personal account
  • Erroneous orders
  • Prizes and other promotional materials
  • Orders for which we do not receive payment in full for any reason

If you return goods or services or if your purchase is the subject of a billing dispute, your Nile Miles balance will be adjusted accordingly.

You cannot pool or combine your Nile Miles with Nile Miles accrued by another account holder. Only accounts kept in good standing are eligible for earning Nile Miles.

2. Redeeming Nile Miles

Nile Miles can be redeemed for a selection of rewards as featured in our Nile Miles substore. Currently, Nile Miles may only be redeemed for Gift Cards. Please check back regularly as rewards are subject to change in the future.

The redemption of Nile Miles for any reason will be administered by us within 3 business days and cannot be reversed.

  • Gift Cards

    Nile Miles may be redeemed for Nile Gift Cards of varying values, at varying rates.

    Nile Gift Cards are subject to availability and the terms and conditions listed on our dedicated Gift Card page.

    Redeemed Nile Gift Cards are not exchangeable and are not refundable, replaceable or transferable for cash or a credit on your account. Nile Gift Cards are valid for a maximum period of 12 months from the date of issue, unless otherwise stated.

3. Changes to these terms

We may add reward partners and reward benefits and make non-material changes to these terms at any time without giving prior notice to you.

We may vary the number of Nile Miles required to purchase a specific reward at any time without giving you prior notice. However, we will give you at least 60 days notice if we choose to significantly increase the number of Nile Miles required to redeem rewards as a whole unless this increase is as a result of an increase in the cost to us in providing such rewards.

We may remove rewards which we believe are not material to the program without prior notice. This may include the removal of certain rewards partners and/or the removal of certain reward products supplied by those partners. For rewards and reward partners which we do consider material to the program we may remove such rewards on giving you no less than 90 days prior notice provided that we shall not be obliged to give you notice if the removal was required by law.

We may make other material changes to these terms and conditions by giving you at least 30 days notice.

4. General

Customers earn Nile Miles for every purchase made on our website from a personal account, starting from 20 September 2010. Redemption of Nile Miles was introduced on 1 December 2010.

Your total balance of Nile Miles earned will be visible under the Nile Miles tab in your account.

Nile Miles cannot be exchanged for cash. Nile Miles are not transferable. Pending Nile Miles in your account have no value.

There is no expiry date for Nile Miles earned provided the account remains active.

If you are in breach of any conditions applicable to Nile Miles, or any other condition outlined by Mercury Retail and its subsidiaries, then any Nile Miles accrued by you relating to disputed orders will be forfeited and your privilege to earn or redeem Nile Miles may be removed. Provided the account has not been cancelled and such request is made within 3 months and you bring your account back into good standing, you may request we reinstate forfeited Nile Miles.

If your account is canceled for any reason aside from error, any Nile Miles accrued in the program account will be forfeited and will not be capable of transfer, conversion or redemption.

Fraud and/or abuse relating to the earning of Nile Miles in the program or redemption of rewards, may result in forfeiture of Nile Miles as well as cancellation of the account.

You are solely responsible for any government tax, duty or other charge imposed by law in any country in respect of the program, your participation in the program, any Nile Miles acquired or redeemed or any other transaction within the program.

Basic shipping within Australia will be provided for all rewards. Overseas shipping may incur further fees.

Our failure to enforce a particular term or condition does not constitute a waiver of that term or condition by us.

We may assign any of our rights under this agreement. We may also transfer our obligations under this agreement to any third party provided we are reasonably satisfied that there will be no detriment to you in the transfer. You agree that we may disclose any information or documents we consider necessary to help us exercise any of these rights. Your rights under this agreement are personal to you and may not be assigned without our written consent.

This agreement is governed by the State or Territory of Australia as stated on your billing address or if your billing address is overseas, as stated on your last known Australian billing address.

Nile Miles accrued in your account are not your property. Subject to our consent, Nile Miles cannot be transferred to any other person, entity or program account, whether by operation of law or otherwise.
