Critics Review
“Burns offers a thoughtful reflection on the timely and vexed topic of the rule of law that distinguishes a rule-following ‘law-of-rules’ from a rule of law that aspires to legality and justice. In a sustained and insightful argument that does not shirk from the complexities of increasingly bureaucratized institutions of criminal, civil and administrative adjudication, Burns prompts readers to think more carefully about how commitments to hearings and procedures relate to who we are.”
– Marianne Constable, University of California, Berkeley“Courts and Bureaucracies is a learned, incisive, and novel examination of modern state governance institutions on a continuum of administration and adjudication. Burns combines highly sophisticated theoretical analysis drawing on a broad range of theories (sociological, philosophical, legal) and theorists with a thorough understanding of the rules, procedures, and actual practices of civil and criminal courts and administrative tribunals.”
– Brian Z. Tamanaha, Washington University Law SchoolRobert P. Burns
